These Terms of Service (the “Terms”) govern your access to and use of the website and online services offered by The Mindful Garden (the “Practice,” “we,” “us,” or “our”), including any forms, scheduling tools, consultation requests, or informational resources accessed through this website (the “Site”). By accessing or using the Site, you agree to be bound by these Terms.

These Terms govern the use of the website only. If you become a therapy client, your clinical relationship will be governed by separate informed consent agreements, Notice of Privacy Practices, and state and federal laws including HIPAA. Nothing on this Site constitutes medical, psychiatric, or psychological treatment.

1) Not Therapy, Crisis Support, or Medical Advice (Website Use Only)

The information on the Site is for educational and informational purposes only. It is not a substitute for therapy, diagnosis, treatment, or medical advice.

• Viewing this Site does not create a therapist–client relationship.

• The therapist–client relationship begins only after a formal intake, signed consent documents, and mutual agreement to work together.

If you are experiencing a crisis or emergency, do not use this Site. Instead, call 911 or go to the nearest emergency room.

2) Eligibility

The Site is intended for individuals who are at least 18 years of age. If seeking therapy for a minor, appropriate consent and legal authorization are required.

3) Scheduling, Consultations & Communication

Requesting or scheduling an appointment through the Site does not guarantee availability.

• Email and SMS may not be encrypted. Avoid including personal or mental health details outside of the secure client portal.

• Clinical intake and telehealth sessions use secure HIPAA-compliant platforms once you become an established client.

4) Fees & Payment (For Clients)

If you enter into a therapeutic relationship with the Practice, fees, insurance billing (if applicable), cancellations, and late-cancellation/no-show policies will be detailed in the Client Services Agreement you receive during intake.

5) Telehealth Disclosure (For Clients)

Telehealth services are available to clients located in states where the therapist is licensed to practice. You must be physically located in the state of New York at the time of any telehealth session unless otherwise permitted by state licensing laws.

6) Intellectual Property

All content on the Site—including logos, branding, text, graphics, photos, and materials—is owned by or licensed to the Practice. You may not copy, reproduce, modify, distribute, or use content for commercial purposes without written permission.

7) Prohibited Use

You agree not to:

• Use the Site for unlawful purposes.

• Attempt to breach or disable security or interfere with the Site’s operation.

• Use automated tools (including bots or scraping tools) without permission.

8) Third-Party Services

The Site may link to third-party platforms (such as scheduling software, telehealth portals, or payment processors). We do not control or endorse these third parties. Their own terms and privacy policies apply.

9) Disclaimer of Warranties

The Site is provided on an “as-is” and “as-available” basis. We make no warranties regarding:

To the fullest extent permitted by law, the Practice and its clinicians are not liable for any indirect, incidental, special, consequential, or punitive damages arising from:

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law provisions.
